Terms of Service

Welcome to Explore Mesa County. These Terms of Service ("Terms") govern your access to and use of exploremesacounty.com (the "Site") and any related services. By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. Eligibility & Accounts

You must be at least 13 years old to use the Site. You are responsible for the information you provide when registering and for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account.

2. User Content

You retain ownership of content you post (reviews, photos, comments, suggested spots, etc. — "User Content"). By posting User Content, you grant Explore Mesa County a worldwide, non-exclusive, royalty-free license to host, display, reproduce, adapt, and distribute it in connection with operating and promoting the Site.

You agree not to post User Content that:

  • Is unlawful, defamatory, harassing, hateful, or threatening.
  • Infringes anyone's intellectual property or privacy rights.
  • Contains spam, malware, or deceptive commercial content.
  • Misrepresents your identity or affiliation with any person or business.

We may remove or restrict access to User Content that, in our sole discretion, violates these Terms or harms users, businesses, or the Site.

3. Acceptable Use

You agree not to:

  • Scrape, crawl, or harvest data from the Site without our written permission.
  • Attempt to gain unauthorized access to accounts, systems, or networks.
  • Interfere with or disrupt the Site or its underlying infrastructure.
  • Use the Site to violate any applicable law or third-party rights.

4. Payments & Subscriptions

Certain features may require a paid subscription or one-time purchase. All payments are processed securely by Stripe, a PCI-DSS Level 1 compliant payment provider. By submitting payment information, you authorize us and Stripe to charge the payment method you provide for the amounts disclosed at checkout, including any applicable taxes and recurring renewal fees.

Subscriptions automatically renew at the end of each billing period until canceled. You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period. Except as required by law, payments are non-refundable.

5. Third-Party Listings & Links

The Site displays information about local businesses, events, parks, restaurants, and other points of interest. We do our best to keep listings accurate but cannot guarantee that hours, prices, availability, or other details are current. Listings and external links are provided for convenience and do not constitute an endorsement.

6. Intellectual Property

The Site, including its design, text, graphics, logos, and software, is owned by Explore Mesa County or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Site without our prior written consent, except as expressly allowed by these Terms.

7. Disclaimers

The Site and its content are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

8. Limitation of Liability

To the maximum extent permitted by law, Explore Mesa County and its contributors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill arising out of or related to your use of the Site. Our total liability for any claim related to the Site will not exceed the greater of (a) USD $100 or (b) the amount you paid us in the 12 months before the claim arose.

9. Indemnification

You agree to indemnify and hold harmless Explore Mesa County and its affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Site, your User Content, or your violation of these Terms.

10. Termination

We may suspend or terminate your access to the Site at any time for any reason, including violation of these Terms. You may stop using the Site at any time. Sections that by their nature should survive termination (e.g. ownership, disclaimers, limits of liability, indemnification) will survive.

11. Governing Law

These Terms are governed by the laws of the State of Colorado, USA, without regard to its conflict-of-laws principles. Any dispute will be resolved exclusively in the state or federal courts located in Mesa County, Colorado, and you consent to personal jurisdiction there.

12. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date above shows the most recent revision. Continued use of the Site after changes take effect constitutes your acceptance of the updated Terms.
